Peshawar High Court has granted interim relief to Afghan citizens, directing the relevant authorities not to harass the petitioners and not to deport them back to Afghanistan.

According to Advocate Saifullah Mohib Kakakhel, the counsel for the petitioners, his clients are individuals who had worked in various programmes with the former US-backed government in Afghanistan and are currently awaiting relocation to third countries.

He argued before the court that due to ongoing actions against Afghan refugees in the country, the petitioners face a serious risk of arrest, detention, and forced return to Afghanistan.

The lawyer further stated that even individuals holding valid visas are sometimes being detained by law enforcement agencies, causing fear and anxiety among affected people.

After hearing the arguments, the court, taking into account the sensitive nature of the case, issued an interim order and directed the concerned authorities not to harass the petitioners and not to deport them to Afghanistan until further orders.

The petitioners also informed the court that such actions violate their fundamental constitutional rights, particularly the right to life and dignity, and that they could face serious threats upon return.

These constitutional petitions were heard by a division bench comprising Justice Waqar Ahmad and Justice Muhammad Fahim Wali.
